Abstract
公共利益是国家征收的唯一前提，公共利益概念的显著特点是其边界的不确定。有必要从伦理的视角对公共利益的内涵进行了解析。历史地看，公共利益从最初的公共团体的善恶取舍到近现代的规范国家制度和社群等组织的行为目的思想，折射出公益价值的正面价值需求和评判。我们对《物权法》中“公共利益”的判定应遵循基本的伦理标准。在法律无法亦不可能对公共利益明确界定的前提下，对国家征收制度本身的正当性价值权衡成为重中之重。权衡应在三个重要向度上进行：一为征收之必要性，二为补偿之公平性，三为程序之正义性。
