Abstract
“我们在法理学中的出发点和旨趣是如此不同，以至于我们永远无法理解对方的作品。”经过 了时间跨度逾10年的两轮辩论之后，1969年，名重一时的美国法学家朗·富勒在自己的代表作 《法律的道德性》的修订版中，增添了题为“对批评者的回应”的长长一章，向他的对手，分析 实证主义法学家H.L.A.哈特发动了第三波反击。不过，他引的哈特的这句原文却是十足的实话： 由于从两个立场、甚至可以说是成见出发，富勒和哈特之间的笔战宣告无果，长寿的哈特后来在 法学史上赢得了一席尊贵之地，但对富勒而言，这场论战更像是一场意义有限的“零和博弈”。
