Abstract
特定的社会伦理观念和伦理规则是各国民法制度赖以建立的基础，也是评价民法制度优劣的主要标准。各国民法无一不是将本国基本伦理制度上升为法律规定的结果。目前中国民事立法所存在的主要问题并不是对外国先进法律制度的移植不够，而是对传统文化的借鉴不足。
