Abstract
The dates for performing hajj or miqat zamani always fall at 9 to 13 Zulhijjah, as it was performed by the Prophet Muhammad SAW. However, in the implementation, it causes many problems, such as expansions of worship places and even the application of hajj pilgrim quota. One of the solutions for the problems is to encourage in doing ijtihad, for example rethinking of adding the amount of time for performing hajj to three months: Syawal, Zulqa'dah and Zulhijjah, as it is mentioned in the Qur'an “al-hajju asyhurun ma’lumat”. Therefore, the courage in doing ijtihad to the message of the Q.S. Al-Baqarah [2] verses 197 and 189 should be carried out, for example by means of usul al-fiqh, particulary in using mantuq–mafhum, ‘am–khas} , rules of al-maslahah and legal theorems (qawa'id fiqhiyyah), as well as legal reasons (‘illah). Thereby, it can be expected that performing hajj in three months should be considered legitimate according to Islamic law. In addition, there are many advantages from this thought, for instances: 1) alleviating the hajj queue in the best way, because there would be three hajj dispathes in every year instead of one,2) the hajj pilgrims would not be bewildered, and 3) the Ministry of Religious Affairs would also be helped out because of lighter management.
