Abstract
在认可关护与公正这两项伦理原则都很重要、都是人类道德判断的基本构成要素的前提 下，我们进而肯定公正拥有优先的地位。这种认知与著名的道德心理学家科尔伯格（Lawrence Kohlberg）有关“关护之道德属于道德发展的较低阶段”的论断没有任何共通之处。恰恰相 反，对于道德情感、对于关护道德的作用，我们从没有、也不可能采取贬低和漠视的态度。正 如哈贝马斯所言，“没有义务与罪责以及谴责与宽恕的道德情感的触动，没有道德尊重的释 放，没有对休戚与共的支持的喜悦，没有对道德失灵感到压抑，没有文明地对待冲突与矛盾上 的‘友善’，我们就会——即便是今天仍然如此——感受到由人类所居住的宇宙是无可容受 的”（30）。
