理想的，也是哲学的。或者说：哲学的，本是理想的。在我们人类法文明的三大构成中，公 法是不同于私法和社会法的法文明部分。私法的立足点或应用主体是我们人类个体，社会法的立 足点或应用主体是我们人类全体，而公法的立足点或应用主体则是我们人类中的群体，是介乎于 我们人类个体与全体之间的群体。
