Abstract
"Al confrontar las correspondiente legislaciones, se advierte una ruptura entre la LTRA de 1988 y el espíritu y doctrina del Tribunal Constitucional español. Así se muestra en la primera a propósito de la diferente valoración jurídica de las fases de preembrión, embrión y feto, la imprecisión del concepto de viabilidad y la identifi cación entre gametos y embrión en determinados supuestos. Frente a ello, la protección legal ha de ser la misma en cualquier fase del desarrollo del viviente, y se ha de evitar que las otras lagunas legislativas conduzcan a una eugenesia discriminatoria carente de justifi cación". ["By contrasting the legislative subjects, a break with the sprit and the doctrine of the spanish Tribunal Constitucional appears in the LTRA 35/1988. The article shows it with regard to the different valuation of the stades of preembryo, embryo and foetus, the vagueness of the concept of viability and the identifi cation of gamets and embryo in determinate assumptions. Against it, the legal protection need to be the same, whatever phase of development it may be, and it´s to avoid the discriminatory eugenics which the other lacks of precision groundless lead to".]
