Abstract
自1764年，近代刑法学之父贝卡里亚在其《论犯罪与刑罚》一书中明确提出废除死刑以来，近两个半世纪里死刑存与废的争论日趋激烈。然而，死刑的命运到底如何？本文中，笔者从自然层面和社会层面对死刑制度进行了比较深入的剖析。从而对死刑的命运作出了合理的考定。
