Abstract
The debate on procedures in case of pregnancy of an anencephalic fetus involves complex ethical issues. After a brief reference to scientific data on anencephaly, this paper aims to study the lines of argumentation and its ethical foundations involved in some arguments at the trial of this issue by the Supreme Court of Brazil. The method takes into account the socio-cultural context, represented by legal aspects, by scientific advances, by current conflicts of beliefs and convictions; and the ethical foundations of the arguments. The results indicate the need for greater openness to dialogue of convictions on the grounds of their arguments, and show that the condition of human person of the anencephalic fetus emerges as a fundamental ethical issue in the debate"]
