关于法律与道德的命题向来是无法回避的，耶林曾将其称为法理学中的好望角，是任何一个想 在法理学的海洋中徜徉的人都绕不过去的一个弯。二十世纪中期哈特与富勒之间的论战主要就是 围绕着这一主题展开的。他们之间曾先后有过三次直接的交锋，[1]并且也相继吸引了众多论者的 积极参与，这次论战被认为是二十世纪西方法理学界一个重大学术事件。《法律的道德性》[2]一 书就是富勒在这次论战的大背景下写就的，它是富勒本人法理学主张的全面展现，是其思想发展 的颠峰之作。
