Abstract
"Resulta significativo que cuando se debate en torno a la necesidad de aumentar la eficiencia del sector agrario, el análisis generalmente se centra en los problemas relativos a las formas de organización de la producción, los precios, la comercialización, el empleo de la fuerza de trabajo, el apoyo financiero o, principalmente, las demandas propias de la agricultura convencional —a saber, la utilización de fertilizantes químicos, pesticidas y maquinarias agrícolas— y la introducción de nuevas tecnologías y semillas “mejoradas genéticamente”. Lamentablemente, no siempre se incorporan al examen, ni se valoran en su justa medida, determinados aspectos de los soportes institucionales y jurídicos mediante los cuales los Estados intervienen en la realización de la justicia agraria con vistas a una mejor ejecución de las políticas agrarias. Es decir, en poca o ninguna medida se toma en cuenta la influencia determinante que ejerce el desempeño eficaz de los mecanismos de ejercicio de la justicia en materia de tierra y bienes agropecuarios sobre los fines que debe lograr el marco jurídico de la actividad agropecuaria.
