Abstract
这篇文章阐明传统中国与西方对人性的观点的一些主要差异，以显示这些哲学观点形成了不同的社会及政治价值，这些价值反映了作为中国及美国政治宪法基础的不同人权理论。我想要证明的是，我们可以从这两个传统中，发展出一个我所谓"有机契约"的研究宪法理论的新途径。 文章分为两部分，第一部分把中国及西方--主要是儒家和康德--对人性的观点两相对照；第二部分则谈政治的分歧，尤其在宪法理论方面。
