Abstract
在一个健全的现代公民社会中，公权和私权两种权利的分野是分明的，公民对公权利、私 权利的畛域应有清楚的了解。公民个体方面，如果在公共场所（如课堂、火车、电梯）内抽 烟、光膀子、随地吐痰、大声说话等，那么就是滥用私权，侵犯他人的公共权利。所以，这些 行为，某种程度上反映出的是存在于一部分人当中的公共空间、私空间界限的模糊和混淆，公 权利、私权利意识的淡薄和混乱。那么，何以如此？这必须从我国传统社会的特点去分析。
