Abstract
笔者认为生命权作为紧急避险的客体，是思想进化与意识形态发展的必然结果。一种理论体系的精髓往往是不可能完全在这个体系内被证明的，况且，法律不是一个自给自足的学科，没有哪条单独的进路能够永久性的捕捉法律的复杂性。我们应该以一种实用主义的态度，吸取各个学科的知识，来完善法律、超越法律。
