Abstract
"No presente artigo pretende-se fazer uma abordagem polémica de um tema igualmente polémico: a manipulação genética. Porém, há que salvaguardar as especificidades: por um lado, porque apenas se atenderá a uma pequena parcela deste fenómeno, ou seja, à manipulação genética aplicada ao Homem, por outro lado, porque irá ser tratado seguindo uma via jurissociológica. Com esta pretende-se debater qual o tipo de normas mais adequadas para legitimar e controlar um fenómeno desta natureza: se jurídicas se éticas. Posto que o assunto é controverso, pretendeu-se, mais do que dar respostas, levantar pistas e questões, bem como apresentar um leque de pontos de vista, tanto quanto possível diversificado e fidedigno, porque oriundo de especialistas ligados à matéria" ["In this article we attempt a polemical approach to an equally polemical subject: genetic manipulation. Nevertheless, we must safeguard the specificities: on the one hand, we only deal with a small part of this phenomenon, that is, genetic manipulation as applied to Man; on the other hand, the subject will follow a jurissociological approach. With this, we attempt to debate the type of norms which most adequately legitimate and control a phenomenon of this nature: whether juridical or ethical. Since the issue is controversial rather than attempt to offer solutions, we propose to raise ideas and questions, as well as to present a variety of points of view, as diversified and trustworthy as possible, from specialists in the field"]
