Abstract
"Este artigo desenvolve uma reflexão crítica acerca do dever de informar do médico, apresentado tanto seus fundamentos jurídicos quanto bioéticos. Situa o paciente como agente moral, sujeito ativo da relação médico-paciente e dotado de vontade autolegislada. Além disso, busca apresentar alguns critérios que possam auxiliar ao profissional da saúde no momento de avaliar quais riscos o paciente deve ter conhecimento para uma tomada de decisão livre e consciente" ["This paper develops a critical reflection on the doctor duty to warn, presenting both as bioethical as legal foundations.
