Abstract
Unregistered marriage is in general phenomenon that mostly be done by people (community). It is like an iceberg phenomenon, small on the surface but very big under the surface. The background of people doing unregistered marriage is very medley. One of the most stick out is cause religious interpretation (Islamic) in order to no occur any sexual act outside of marriage. The Law about marriage (UU No. 1/1974) was medley interpretated by people. Article 2 subsection 1 for example, mentioned that marriage is legal if be done accordingly to religious law or the faith. In the subsection 2 mentioned that the marriage must be registered to the state, but it no straight off encourage people to register their marriage because the people had interpretation that marriage is religious activity (ibadah) so that need not be registered. Else, expensive cost for married, and there is comphrehension that mentioned legal in the religious, in the same manner as regulated in the law about marriage (UU No.1/1974) article 2 subsection 1. For Islamic people, the marriage is legal if fulfilling Islamic law and requirment. Two determinate that no made as one unity (registry), separately, becoming that subsection causing multy interpretative and can be use to married again. The several of reason, background or the factor that causing the people done unregistered marriage in the community is influenced by multiple views like religious, economic, social, law or cultural. In the fact, there is interelation between five factors to others.
