Abstract
"In White Tanks Concerned Citizens, Inc. v. Strock, the Ninth Circuit addressed the scope of federal environmental analysis required for wetland fill permits issued in connection with larger, otherwise nonfederal development projects.1 Often called the “small handles” problem, courts have struggled with the extent to which an environmental analysis under the National Environmental Policy Act (NEPA) must consider the entirety of a private development or just those components subject to direct federal jurisdiction."
