Abstract
"A pesquisa científica é uma atividade incoativa, não reconhece uma norma precisa a priori; no entanto, esforça-se por não cair na cilada oposta da arbitrariedade. No desenvolvimento próprio cria suas normas. As pesquisas visam, ao mesmo tempo, a construção de um saber, a apuração constante de uma metodologia e a instauração de uma norma. Uma análise epistemológica tenta compreender não meramente a ciência constituída e seus métodos, mas, sobretudo a gênese dos procedimentos, suas condições de possibilidade, as intuições, seus métodos e critérios de autocrítica. Quanto às investigações que tomam por objeto o ser humano, qual deve ser a posição a ser tomada? Sob que condições é plausível defender-se a direito e a liberdade de investigação respeitando-se a dignidade da pessoa humana? A Bioética tem entre outros objetivos o de analisar e avaliar as investigações com seres humanos nas áreas biomédicas. Está em foco a "experimentação humana", a pesquisa envolvendo seres humanos, seja com objetivo de adquirir novos conhecimentos, seja com objetivo terapêutico. O presente trabalho visa analisar, de modo sucinto, essa questão no cenário de documentos oficiais na área de Bioética como: O Código de Nuremberg, A Declaração de Helsinki-Edimburg (2000) da Associação Média Mundial (AMM); A Declaração Universal sobre o Genoma Humano e os Direitos do Homem da Unesco (1997); o Relatório Belmont" [" Scientific research is an inchoative activity, not recognizing an a priori necessary norm; however, it makes efforts not to fall in the opposing ambush which is arbitrariness. In its own development it creates its norms. Research aims at the same time both at the construction of knowledge and the constant verification of a methodology and the instauration of a norm. An epistemological analysis tries to only to understand established science and its methods, but mainly the genesis of the procedures, their conditions of possibility, intuitions, its methods and criteria for an self-critique. Regarding researches that have human beings as subjects, which position must be taken? Under what conditions is it reasonable to defend the right and the freedom of research respecting human dignity? Bioethics has among other objectives to analyze and evaluate research with human beings in the biomedical areas. Its focus is "human experimentation", research involving human beings, both to acquire new knowledge or with therapeutic ends. The present work aims to briefly analyze this question in official bioethical documents: The Nuremberg Code, the Declaration of Helsinki-Edimburg (2000) of the World Medical Association (WMA); the Universal Declaration on the Human Genome and the Rights of Man by UNESCO (1997); and the Belmont Report"]
