Abstract
"O presente artigo busca, através de uma analítica histórica e de uma reflexão filosófica sobre a Declaração Universal dos Direitos Humanos, a fundamentação dos mesmos direitos, em nível metafísico e ético (o naturalismo do ser e a moral natural), fazendo ver, que o Direito Natural se encontra dentro de uma estrutura dialogal onde o ser e o dever ser estão em conexão como paradigma para a humanização do Direito, com vistas aos limites do legal e do ilegal, inseridos em uma ética e na metafísica humanizadas" ["This article aims, through a historical analytical and philosophical reflection on the Universal Declaration of Human Rights, the reasoning of the same rights, in metaphysical and ethical level (naturalism of being and the natural moral), making see that the Natural law is within a dialogical structure where being and should be are in connection as a paradigm for humanization of the law, in order to limit legal and illegal, inserted in an ethical and humane metaphysics"]
