Abstract
"O pós-positivismo apresenta-se, no Direito, como a superação da objetividade científica querida pelos positivistas, os quais tinham como princípio norteador a estrita legalidade; conseqüentemente a interpretação jurídica restringia-se à subsunção dos fatos à norma, atribuía ao juiz a mera função de “boca da lei”, apenas revelando a vontade do legislador, sem qualquer contribuição criativa. O Positivismo, por ter rompido com a moral, não realizava qualquer discussão sobre a legitimidade do Direito e sobre a Justiça, demonstrando-se indiferente a quaisquer valores éticos" ["The postpositivism presents itself in the law, such as overcoming the objectivity scientific beloved by positivists, which had as a guiding principle the strict legality; therefore the legal interpretation restricted to the subsumption of the facts to the rule, attributed to judge the mere function of "mouth of the law", only revealing the will of the legislature, without any creative input. Positivism, having broken with the moral, not held any discussion about the legitimacy of the law and on justice, proving to be indifferent to any ethical values"]
