Abstract
在人类法律文化之林中，传统中国法之所以能够独树一帜，部分是因为它悠久的历史和深远的影响，部分还由于它精深的学理。对于前者，学界多有研究，特别是随着中国法制现代化的展开，这类研究至今未曾停止。对于后者，学界虽亦有关注，但成果大都集中在对制度本身和对儒、法、道三家法思想的探讨上。如何对传统中国法在整体上作原理性的把握，揭示贯通诸子百家同时又支配传统中国法发展的一般理论，仍然是一个薄弱环节。
