近代人权学说是西方政治法律文化传统的产物。西方传统社会存在的契约型的社会 关系及契约社会中个人的成长，中世纪政权与教权的分化、多元化的权力体系以及权利斗争传 统，是人权学说形成的社会历史渊源。斯多葛派和基督教的政治价值观和罗马法中形成的权利概 念，构成人权学说的思想来源。
