Abstract
在反对机械法学，以及反对完全漠视社会生活事实而进行自鸣得意的法律概念计算的过程中，应当警惕 避免将婴儿连同洗澡水一并倒掉。鉴于一些传统的法律概念 —— 诸如权利、所有权、契约等等 —— 已 遭到大量滥用，我们还是应该认识到，如果不借助于概念和一般原则，法律乃至其他任何领域的科学将 不复存在，也无法系统、清晰地对其进行描述。另外，法律迫切需要体系，这不仅是出于理论的需要， 也是实践的要求。如果失去了普遍的概念，人类经验就会变得愚钝、盲目。
