Abstract
"O presente trabalho pretende problematizar uma discussão que ganhou espaço no cenário jurídico brasileiro através das críticas capitaneadas por Virgílio Afonso da Silva ao dizer que “[...] No caso dos métodos de interpretação constitucional [...] não é a irrelevância de alguns deles ou a falta de diferenciação entre eles que limita a importância da discussão. O grande problema, nesse âmbito, é o sincretismo metodológico”. A proposta aqui é saber se a postura metodológica é capaz de suprir a subjetividade do intérprete (que estaria presente no sincretismo) através de fórmulas e conceitos prédeterminados. Tal postura interpretativa acredita que esse caminho é a direção segura e racionalmente capaz de demonstrar decisões aceitáveis por todos os participantes" ["This paper aims to discuss an argument that has gained ground in Brazilian legal scenario through critical captained by Virgilio Afonso da Silva to say that "[...] In the case of the methods of constitutional interpretation [...] is not the irrelevance of some of them or the lack of differentiation between them which limits importance of the discussion.
