Abstract
"A regulação ética da prática científica foi desencadeada por denuncias e comprovações de crimes contra pessoas, grupos étnicos e sociais e segmentos populacionais, a partir da II Guerra Mundial. O surgimento e a consolidação da Bioética como campo científico e prática social é expressão do sucesso desse movimento regulatório. Contudo, o envolvimento de seres humanos em pesquisa persiste como objeto de preocupação mundial. Uma das dimensões mais significativas dessa preocupação origina-se na vulnerabilidade a que estão expostos ou são submetidos os indivíduos e coletividades humanas no contexto de projetos de pesquisa realizados mediante cooperação internacional. O presente artigo desenvolve uma reflexão sobre critérios que caracterizam a vulnerabilidade nesse contexto: fragilidade na capacidade nacional de realizar pesquisas; nível de pobreza das pessoas ou populações; acesso aos serviços de saúde; grau de instrução da população; condições associadas a gênero, etnia e local de domicílio. O objetivo é analisar os limites da Resolução 196/96 do Conselho Nacional de Saúde que regula as pesquisas com seres humanos no Brasil frente ao propósito de proteger os vulneráveis, abordando alguns aspectos dessa temática na perspectiva das relações internacionais no campo da saúde" ["The ethical regulation of scientific practice since World War II was triggered by accusations and confirmation of crimes against individuals, ethnic and social groups, and different segments of a population. The emergence and the consolidation of Bioethics as a scientific field and a social practice is the expression of the success of this regulatory movement. Nevertheless, the involvement of human beings in research persists as an object of serious concern worldwide. One of the most important dimensions of this concern pertains to the vulnerability to which groups and individuals are exposed or subjected during the course of research projects developed in the context of international cooperation. This study reflects upon characteristics of such vulnerabilities: fragility of the national capacity to conduct research; degree of poverty of the population and some of its segments; accessibility to healthcare; degree of literacy of the population; and conditions associated to gender, ethnicity, and place of residence. The goal is to analyze the limitations of Resolution 196/96 enacted by the National Health Council (CNS – Conselho Nacional de Saúde), which regulates research on human beings in Brazil, purporting to protect vulnerable populations, while addressing some of these aspects from the perspective of the international relations in the field of healthcare"]
