Abstract
法治是一项以人的需要为起点，并以人的幸福为归宿的事业。但凡攸关人之需要和幸福的事业，都有其内在的伦理法则。法治亦然。现代法治的正当性至少应满足人本、人道和人文三项最低限度的伦理法则。
