Abstract
"A segunda metade do século XX e o início do século atual têm sido marcados por uma intensa interação de conhecimentos. A tradição positivista de setorização parece ceder lugar novamente à dialética entre os saberes. No caso do Direito e da Bioética, pode-se observar, acompanhando suas trajetórias, que, partindo de caminhos distintos, dirigiram-se a pontos convergentes, de que é exemplo maior a Declaração Universal sobre Bioética e Direitos Humanos. A própria denominação Biodireito indica essa disposição de integrar conhecimentos, ainda que com as dificuldades decorrentes da própria diversidade de naturezas entre o caráter eminentemente dogmático do Direito e o aspecto mais zetético, filosófico e questionador da Bioética. Outro ponto de evidente interface se encontra na atual propensão à judicialização nas relações de saúde. Ao passo em que se vive uma medicalização da vida, sujeitando-a à manipulação tecnológica mesmo em seus aspectos mais naturais, observa-se uma tendência a judicializar as relações de saúde, submetendo ao Direito a solução de questões nesse setor, em que pese ele nem sempre se achar aparelhado para responder a desafios tão novos como aqueles que os avanços das biociências suscitam. Essa termina sendo, então, uma das principais perspectivas de interação: como pode a Bioética auxiliar o Direito em respostas para as quais ele ainda não tem elementos em seu próprio corpo, sem, com isso, aprisionar uma disciplina à outra? A discussão, a difusão do conhecimento, as possibilidades de acréscimos decorrentes do cabedal epistemológico desenvolvido pela Bioética nos últimos quarenta anos parecem ser, nesse sentido, um grande ganho para o Direito e para a sociedade à qual ele serve, demandando, contudo, interesse, disposição e boa vontade dos profissionais, tanto da área de saúde quanto da área jurídica, a fim de travar e enriquecer esse diálogo, colaborando com ele para o empoderamento e o crescimento do ser humano" ["The second half of the Twentieth century and the principle of this century have been marked by an intense interaction of knowledge areas. The positivistic tradition of sectorialization seems to be once again replaced by the dialectics among knowledge areas. In the case of Right and Bioethics, it is possible to observe, accompanying their trajectories, different departure points and a convergence, the biggest example of which is the Universal Declaration on Bioethics and Human Rights. The very name, Bioright, indicates this integration of knowledge areas, although with the difficulties resulting from the diversity of natures, the eminently dogmatic character of Right and the aspect more zetetic, philosophical and critical of Bioethics. Another point of obvious interface is the current trend of judicialization of health relations. As medicalization of life happens, subjecting it to technological management even it most natural aspects, health relationships show a tendency to judicialization, subjecting to Right the solution of questions in health, although it is not always prepared to respond to challenges so new such as those caused by advances in biosciences. This is one of the main perspectives of interaction: how may Bioethics help Right in answers for which this latter has no elements of its own, without imprisoning a discipline to the other? Debate, diffusion of knowledge, the possibility of enhancements resulting from the epistemological wealth developed by Bioethics in the last forty years seem to be, in this sense, a great contribution to Right and the society it serves, demanding, nevertheless, as regards right, commitment, effort and good will of professionals, mainly from the health field, in order to engage in and make this dialog rich, collaborating for the empowerment and evolution of human beings"]
