Abstract
关于公共利益与个人权利相互冲突的理论观点和实践形态主要有三种，即：对立 统一论、个人权利本位论和公共利益本位论。实际上，公共利益与个人权利相互限制，又相互 依存。在公共利益实现、公共利益与个人权利协调中，道德、制度、习俗文化等的作用只是一 个方面，主要是从制度上提供立法、行政和司法保障。
