Abstract
"O presente artigo condensa reflexões que fundamentam atitudes diante da questão da anencefalia. Após a conceituação da mesma são analisados argumentos favoráveis à prática do aborto em tais casos, mas logo em seguida os mesmos são refutados em nome da valorização da pessoa do ser anencefálico. Assim o ser anencefálico não é uma coisa ou um mero amontoado de células mas um ser distinto da mãe. Ainda que pequena, ele tem uma vida extra-uterina que deve ser respeitada. O sofrimento da mãe não justifica sua eliminação. A liberdade dos outros deve respeitar sua liberdade de ser, existir e nascer. À consciência dos outros não é permitido matar alguém tão desprotegido e inocente. O poder do Estado em fazer leis é limitado pelos direitos dos seres humanos em existirem. Só pode existir democracia quando os direitos das minorias, principalmente mais fracas, forem assegurados, incluindo o de nascer, anencefálico ou não. Anencefalia requer solidariedade em cuidar de alguém que tanto precisa. Finalmente ética é procurar desenvolver as potencialidades do ser humano, por mínimas que estas sejam. Assim devem ser superados tanto a ética do utilitarismo de preferência como o darwinismo social, colocando cada ser humano, mesmo o anencefálico, como único, pessoal e irrepetível na sua dignidade" ["This article condenses reflections that serve as a basis for attitudes about the question of anencephaly. After conceptualizing anencephaly, we analyze arguments favorable to the practice of abortion in such cases, but soon after we present arguments that refute them on behalf of the valuation of the anencephalic being's person. Thus, the anencephalic being is not a thing or a mere cell cluster but a being distinct from the mother. Although small, it has a extra-uterine life that must be respected. The mother suffering does not justify its elimination. The freedom of others must respect its freedom of being, existing and be born. The conscience of others is not allowed to kill somebody so unprotected and innocent. State power to legislate is limited by the rights of human beings to exist. Democracy can only exist when the rights of minorities, mainly weaker, is assured, including that of being born, with anencephaly or not. Anencephaly requires solidarity in taking care of one that needs it so much. Finally, being ethical is to promoting the development of the potentialities of human beings, for little these might be. So, one must surpass both the ethics of preference utilitarianism and social darwinism, placing each human being, even anencephalic, as unique, personal and unrepea-table in their dignity"]
